BREAKING NEWS: Large Employers Win Major Supreme Court Battle Against Biden Vaccine Mandates

In a landmark decision, the highest court in the land ruled against the Biden administration’s mandate requiring large employers to force employees into either getting vaccinated or undergo weekly testing. 

This past November, the Occupational Safety and Health Administration (“OSHA”) issued a mandate that would have required employers with 100 or more employees to implement protocols demanding vaccination or weekly testing amongst their workforce. In a similar mandate, the Center for Medicare and Medicaid Services (“CMS”) required COVID-19 vaccinations for certain health care workers.

After two dozen states filed lawsuits, and over four hours of oral argument this past Friday, the Supreme Court of the United States found OSHA “overstepped its authority,” rejecting a mandate that would have affected 84 million employees. 

The Court will allow the CMS mandate, calling for required vaccination of certain healthcare workers employed at hospitals, nursing homes, and other medical facilities that participate in Medicare and Medicaid programs. This mandate covers roughly 10.3 million health care workers.
