Paid Family and Medical Leave Update

As Massachusetts employers are no doubt aware, employer obligations under the new Paid Family and Medical Leave law go into effect soon. However, on May 1, 2019, the Massachusetts Department of Family and Medical Leave announced a change in deadlines for some of these obligations.

First, the deadline for filing for a private plan exemption has been extended from June 30, 2019 to September 20, 2019. Applications will still be accepted on a rolling basis. However, the deadline extension does not change to date on which employer contributions begin. According to the Department of Family and Medical Leave, the extension of the exemption application deadline only impacts contribution requirements if the exemption request is approved. If the exemption request is not approved, the applicant company will need to remit the full contribution amount from July 1, 2019 forward.

Second, the deadline for providing notice to employees has been extended from May 31, 2019 to June 30, 2019. The required notice includes mandated display of an approved PFML workplace poster, written notice of PFML benefits, contribution rates and other provisions under M.G.L. c. 157M, § 4 to all current workers, and all new employees hired thereafter. This notice may be provided electronically. Employers also must obtain written acknowledgement of receipt of such information by the employee (or otherwise obtain a statement indicating the employee’s refusal to sign such an acknowledgement). Violation of the notice provision can result in a civil penalty of $50 per employee, and for each subsequent violation, a penalty of $300 per employee.
