Published by the Centers for Medicare and Medicaid Services (CMS), the HCBS Community Rule is intended to assure that individuals receiving long-term services and supports have full access to the benefits of community living and the opportunity to receive services in the most integrated settings possible.
All providers who operate HCBS programs under sections1915 (c), 1915 (i), and 1915 (k) of the Medicaid statute, in both residential and non-residential settings, are subject to the Rule and must implement any necessary changes now to bring their programs into compliance with its new requirements.
