MA SJC Ruling on Overtime/Sunday Pay

The Massachusetts Supreme Judicial Court (“SJC”) ruled yesterday that retail salespeople who are paid entirely in commission or draws (i.e. advance on commissions) are entitled to additional overtime or Sunday pay.  This means that those salespeople are now entitled to separate and additional payments of 1.5 times the minimum wage for every hour worked in excess of 40 hours or hours worked on Sunday during that pay period.  Employers will no longer be able to make commission payments at the end of the month to compensate employees for all hours worked during the previous month.
