Case statistics from the federal courts show a disconcerting trend for employers regarding wage and hour lawsuits. Statistics cited in reports by the Administrative Office of the United States Courts indicate a massive increase in claims filed in federal courts under the Fair Labor Standards Act (FLSA) since 2001. According to the agency’s 2001 report, 1,961 cases involving FLSA claims were filed nationwide between April 1, 2000 and March 31, 2001. The agency’s 2014 report, in contrast, shows that a staggering 8,126 cases were filed in federal courts under the same statute in the twelve months leading up to March 31, 2014—an over 400% increase in thirteen years.
The trend towards greater litigation of wage and hour law claims demonstrates the importance of employers taking steps to ensure compliance with the FLSA and state wage and hour law.
