The Essential Dos and Don’ts of Terminating an Employee

You have pleaded, counseled, warned, and “threatened” an employee with respect to poor work performance and/or a record of (hopefully documented!) negative workplace behavior(s). The time has come, or perhaps is long overdue, for the workplace equivalent of capital punishment, i.e., termination.

 

Attorney Elaine Reall conducted a seminar on September 11, 2024, on the exploration of the good, the bad, and the ugly surrounding employee terminations. The attendees explored effective strategies to lessen their organization’s exposure to time-consuming administrative agency complaints or legal actions.

Our attorneys successfully obtained summary judgment in favor of the Defendant from the Massachusetts Appeals Court in a Wage Act and contract dispute. The Complainant alleged entitlement to a substantial variable compensation award following resignation. We demonstrated that the compensation plan made such awards discretionary and contingent on continued employment at the time of payout. The Appeals Court agreed, finding that the award did not constitute wages under the Wage Act and that the Defendant acted lawfully in denying payment. All claims were dismissed in their entirety.
