New Charges Accepted by the EEOC under the Pregnant Workers Fairness Act
Today, Tuesday, June 27, 2023, the Pregnant Workers Fairness Act (PWFA) takes effect. The PWFA will expand protections to ensure that workers who are experiencing pregnancy, childbirth, or related medical conditions have the right to reasonable accommodations in the workplace.
Employees of "covered employers" are protected by the PWFA. ”Covered employers” include private and public sector employers with at least 15 employees, Congress, Federal agencies, employment agencies, and labor organizations.
President Joe Biden signed the PWFA into law on December 29, 2022.
The Equal Employment Opportunity Commission (EEOC) will analyze charges regarding accommodations for workers under the PWFA. Charges related to incidents that occur on or after June 27, 2023 will be accepted by the EEOC.
The PWFA builds upon existing protections against pregnancy discrimination under Title VII of the Civil Rights Act.
