Royal attorneys successfully obtained a dismissal at the Massachusetts Commission Against Discrimination (MCAD) in a case against our client, a large not-for-profit organization. Royal attorneys argued that the Complainant's complaint failed to establish a prima facie case of whistleblower retaliation and that it should be dismissed in its entirety. The MCAD agreed with our argument, and dismissed the case against our client.

Royal attorneys successfully obtained a dismissal at the United States District of Massachusetts for their client. The Plaintiff alleged Misrepresentation, Breach of Contract, Breach of Implied Covenant of Good Faith and Fair Dealing, Detrimental Reliance, and Unfair and Deceptive Trade Practices in Violation of Massachusetts General Laws Chapter 93A, §11 in relation to an alleged unpaid share of stock from the sale his former company. Royal attorneys argued that the Plaintiff did not establish the prerequisite principal-agency relationship to impute liability on our client. The Court agreed with our argument and dismissed the case against our client.

Royal attorneys successfully obtained a dismissal at a Massachusetts Trial Court for their client. The Plaintiff alleged there was a failure to pay wages. Royal attorneys argued that the Plaintiff voluntarily resigned and did not earn PTO and sick time that were allegedly owed. The Court agreed with our argument and dismissed the case against our client.

Royal attorneys successfully obtained a dismissal at the Massachusetts Commission Against Discrimination for their client. The Complainant alleged discrimination on the basis of sex and retaliation. Royal attorneys argued that Complainant failed to provide a medical note, and was a no-call, no-show for a 3-day period, in violation of the employee handbook. The MCAD agreed with our argument and dismissed the case against our client.

Royal attorneys successfully obtained a Partial Motion to Dismiss of claims in a Title VII, Rhode Island Fair Employment Practices Act, (RIFEPA), Rhode Island Civil Rights Act (RICRA), and Rhode Island Payment of Wages Act (RIPWA) case at the United States District Court – District of Rhode Island. The Plaintiff alleged discrimination on the basis of race, color, retaliation, ethnicity, age, and a hostile workplace. The Court agreed with our arguments and dismissed Counts I and II, as they relate to ethnicity and age, from the case.

Royal attorneys successfully obtained a Partial Motion to Dismiss of claims in a Massachusetts Wage Act case at the United States District Court – District of Massachusetts. The Plaintiff alleged failure to pay wages earned and owed, unlawful discrimination, and retaliation in the Complaint. The lawsuit was brought against the Defendant company and the Defendant company’s CEO. The Court agreed with our arguments and dismissed the individually named Defendant from the case.

The Complainant alleged discrimination on the basis of gender discrimination. Royal attorneys argued that Complainant failed to set forth any support for such assertion, and that Complainant was treated reasonably and no different than any other individual.

The Massachusetts Commission Against Discrimination (MCAD) has dismissed a case against our client, a small locally-owned business. The Complainant alleged discrimination against our client on the basis of disability. Royal attorneys argued that the Complainant was terminated after a series of no-call/no-shows. Additionally, our client does not employ six (6) or more individuals, and is therefore not considered an employer under M.G.L. Chapter 151B. The MCAD agreed with our arguments, and dismissed the case against our client.

Royal attorneys successfully obtained a dismissal at the Massachusetts Commission Against Discrimination (MCAD) in a case against our client, a large not-for-profit organization. The Complainant alleged discrimination against our client on the basis of race/color. Royal attorneys argued that the Complainant had repeatedly failed to meet productivity standards and documentation requirements. The MCAD agreed with our argument, and dismissed the case against our client, finding of a lack of probable cause.

The Complainant alleged discrimination against our client on the basis of disability and retaliation. Royal attorneys argued that the Complainant had ongoing performance problems and was not performing the essential functions of the job. MCAD agreed with our argument, and dismissed the case against our client.
